Employers with 50 or more employees cannot afford to treat benefits compliance as an enrollment-only task.

If your organization averaged at least 50 full-time employees, including full-time-equivalent employees, during the prior calendar year, it may be an Applicable Large Employer under the ACA. That determination can bring important coverage, affordability, reporting and documentation responsibilities.

Section 125 is a separate—but closely connected—responsibility. Employer size alone does not make a cafeteria plan mandatory. However, when employees pay eligible benefit premiums on a pre-tax basis, the employer should have a properly adopted written plan and administer elections, payroll deductions and permitted changes consistently with that plan.
